Is sperm Donation Legal in India?


Yes, sperm donation is legal in India. There is nothing illegal in Sperm Donation in India. Not only that, it is legal for a guy to donate sperm and a girl to donate eggs in India. As the name suggests, sperm donation is the donation of sperm for one who wants to conceive a baby. The process involves collecting the semen( fluid or thick liquid which is released during ejaculation) and donating it to the donation centre. This process helps or assists couples or individuals who wanted a baby but can't conceive it. This helps them in conceiving a baby.

 

Why Sperm Donation?

 

Sperm donation is a safe procedure. It is quite effective and doesn't have any risk involved in it. Any male can choose to donate his sperm. The man who wants to donate sperm has to go through a full medical check-up. This medical screening is to ensure about any risks or problems before donating the sperms. If the person is medically fit then he can help a female conceive a baby. It can be for any reason like a single woman wanting a child or a couple facing a problem with male infertility.

 

What Happens to Donated Sperm? 

 

Whenever a man wants to donate sperm, he needs to go through a complete medical checkup. After that, he has to collect his semen and submit it to the sperm bank. There, they are stored in special conditions. When a female requires sperm, then they are taken out inseminated into the female's reproductive organs. The process of this type of insemination is also known as intrauterine insemination. In some cases, the donated sperms are used for the fertilization of the matured eggs. This process takes place in the laboratory under guidance of an expert. This process is called in vitro fertilization or IVF. The identity of a sperm donor can be anonymous or known by the recipient of the sperm. If the recipient knows the identity donation of the person who has donated that sperm, then it is called directed donations. 

 

Procedure of donating sperm

 

For a man to donate sperm, he should be mentally prepared for its long-term impact. Donating sperm means being biologically the father of the child or children, whoever gets the child from that sperm. Every possible situation should be well thought out before donating sperm. If required, prepare a legal contract about the rights and obligations. 

The procedure of donating sperm is as follows. 

  • Before donation - The donor has to take a complete checkup. The doctor goes through complete medical history, physical tests and blood investigation. Then, there is a psychological evaluation with a psychotherapist. The age of the donor should be between 18 to 39 years, as preferred by most sperm banks. Check for any genetic or hereditary disorder through blood samples. Before actually donating, the person has to provide some semen samples. After this, person's sexual history and addictions are checked. After all screening, the person has to sign a consent form. 
  • During the procedure - The procedure  is done at the sperm bank. The donor gets a private room. He has to collect the semen in a container provided by the bank and hand it to the bank. 
  • After donation - The Sperm Freezing takes place and is kept in quarantine for at least 180 days. It is checked from time to time for any infectious disease, quantity, movement, and quality.
